About these terms
These terms apply to everything you buy from heavenlygardenstore.com. Please read them before you order. Our full company details are at the bottom of this page.
Our products
We are a retailer, not a manufacturer. Every product is built and delivered by its manufacturer. Images are illustrative, and timber is a natural material, so colour, grain and knotting vary between items. Dimensions are those supplied by the manufacturer and are nominal — please measure your space against the stated base dimensions rather than the nominal size.
We describe our products as accurately as we can. If something you receive does not match its description, tell us and we will put it right.
Prices
Prices are in pounds sterling and include VAT at the current rate. Delivery is included to UK mainland on most products. Where a surcharge applies to your postcode, it is shown on the product page or confirmed with you before your order is placed — never afterwards.
Product images and descriptions
Photographs on our site are representative of the product range and not of the individual item you will receive. Timber is a natural material and colour, grain and knot pattern vary between boards and between batches. Buildings are frequently photographed treated or stained, and will be supplied in their standard finish unless the specification says otherwise.
Images may also show staging that is not included in the price — furniture, planting, paving, lighting, flooring, guttering, shelving and similar. Only the items set out in the written specification on the product page are supplied. Where an image and the written specification differ, the written specification applies. If any detail shown in an image is important to you, contact us before ordering and we will confirm it in writing.
Dimensions are nominal and stated to the manufacturer's own convention, which may be external or internal and may include or exclude the roof overhang. Where a precise dimension matters, ask us and we will obtain it from the manufacturer before you order.
We work hard to price correctly, but if we find an error in the price of something you have ordered we will contact you before processing it, and you can either confirm at the correct price or cancel for a full refund.
How a contract is formed
When you place an order you are offering to buy from us. Our acknowledgement email confirms we have received your order — it does not mean we have accepted it. A contract is formed when we confirm your order with the manufacturer and send you confirmation that it is being made. If we cannot supply something, we will tell you and refund you in full.
Availability and lead times
Lead times shown on each product are the manufacturer's current estimate and begin when your order is confirmed, not when you place it. They can change with production and transport capacity. We will always tell you if a date moves rather than letting it pass quietly.
Occasionally a manufacturer discontinues a product or cannot supply it. If that happens we will contact you the same working day with your options, including a full refund.
Delivery
Delivery is kerbside unless the product page says otherwise, and you will need suitable vehicle access and a firm, level route to the drop point. Full details are in our Shipping policy. If a delivery cannot be completed because of access, or because nobody is there to receive it, the manufacturer may charge for the attempt and we will have to pass that charge on.
Preparing a level, firm base before delivery is your responsibility.
Delivery dates and timing
Lead times shown on our product pages, in your order confirmation and in any correspondence are estimates based on the manufacturer's current production schedule. They are not contractual delivery dates and time is not of the essence of the contract.
We will keep you informed of any change and we will never knowingly give you a date we do not believe. We are not liable for any costs you incur in reliance on an estimated date — including installer or tradesperson fees, equipment or skip hire, or time taken off work — before your delivery date has been confirmed by the manufacturer.
None of this affects your statutory rights. Where no delivery period has been agreed, goods will be delivered without undue delay and in any event within 30 days of the contract. If we fail to deliver within that period, or within any later period we agree with you, you may treat the contract as at an end and receive a full refund.
Cancellation, returns and faults
Your rights to cancel and return are set out in our Return and refund policy. Nothing in these terms affects your legal rights as a consumer, including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Please check your delivery before you begin assembly and tell us within 48 hours if anything is damaged or missing, with photographs. Manufacturers work to short reporting windows and a late report can invalidate a claim.
Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for loss or damage that is not foreseeable, or for losses arising from a product being installed on an unsuitable base or assembled incorrectly.
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for any breach of your legal rights in relation to the products.
Events outside our control
We are not liable for delays caused by events outside our reasonable control, including extreme weather, industrial action, or manufacturer and transport failures. If such an event causes a significant delay we will contact you, and you may cancel for a full refund.
Governing law
These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
